“Modifica della disciplina normativa relativa alla tutela della maternità delle donne dirigenti”
pubblicata nella Gazzetta Ufficiale n. 64 del 17 marzo 2006
ART. 1.
1. La tutela previdenziale relativa alla maternità, prevista dal testo unico delle disposizioni legislative in materia di tutela e sostegno della maternità e della paternità, di cui al decreto legislativo 26 marzo 2001, n. 151, è estesa alle lavoratrici e ai lavoratori appartenenti alla categoria dei dirigenti che prestano la loro opera alle dipendenze di datori di lavoro privati, in deroga all’articolo 6, secondo comma, della legge 11 gennaio 1943, n. 138.
ART. 2.
1. Agli oneri derivanti dall’attuazione della presente legge, pari a 11.700.000 euro annui, si provvede mediante il versamento obbligatorio da parte dei datori di lavoro del contributo per l’assicurazione per la maternità delle donne dirigenti, a valere sulle retribuzioni dei lavoratori dipendenti con qualifica di dirigente, nella misura prevista dall’articolo 79, comma 1, del testo unico delle disposizioni legislative in materia di tutela e sostegno della maternità e della paternità, di cui al decreto legislativo 26 marzo 2001, n. 151, in considerazione dei diversi settori produttivi.
2. L’Istituto nazionale della previdenza sociale (INPS) provvede al monitoraggio degli effetti finanziari derivanti dalle disposizioni introdotte dalla presente legge comunicando i risultati al Ministero del lavoro e delle politiche sociali ed al Ministero dell’economia e delle finanze. Qualora nel corso dell’attuazione della presente legge si verifichino o siano in procinto di verificarsi scostamenti rispetto all’importo di cui al comma 1, si provvede a rimodulare le aliquote contributive di cui all’articolo 79, comma 1, del testo unico di cui al decreto legislativo 26 marzo 2001, n. 151, con la procedura di cui al comma 5 del predetto articolo 79, nella misura necessaria a fare fronte allo scostamento e limitatamente ai soggetti di cui all’articolo 1. Il Ministro del lavoro e delle politiche sociali riferisce al Parlamento, con propria relazione, sulle cause e l’entità dei suddetti scostamenti e sulla misura della variazione delle aliquote di cui al precedente periodo.
